1. Agreement to Terms

By accessing or using Postmarks (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Trip Wizard LLC ("we," "our," or "us"). Please read them carefully.

2. Description of Service

Postmarks is a mobile application that transforms your daily walking activity into a virtual travel experience. By connecting to your device's health and fitness data, the app tracks your steps and maps them to real-world routes, allowing you to unlock virtual stamps and journal entries as you progress.

The Service includes both free features and premium features available through a subscription ("Postmarks Premium").

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You must be at least 13 years old to create an account. If you are under 18, you must have permission from a parent or guardian.

4. Health Data and Permissions

Postmarks requires access to your device's Health app (iOS) or Google Fit (Android) to read step count and walking distance. By using the Service, you consent to this access and acknowledge that:

• Accuracy of health data depends on your device's sensors and settings
• You can revoke health data access at any time through your device settings
• Step counts are estimates and may not reflect actual physical activity
• We are not responsible for health data inaccuracies or syncing issues

Always consult a healthcare professional before beginning any exercise program.

5. Subscriptions and Payments

5.1 Free and Premium Features

Certain features of Postmarks are available for free. Premium features require an active subscription ("Postmarks Premium").

5.2 Billing

Subscriptions are billed through your device's app store (Apple App Store or Google Play Store). Payment will be charged to your account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

5.3 Cancellation

You may cancel your subscription at any time through your app store account settings. Your subscription will remain active until the end of the current billing period. No refunds will be provided for partial subscription periods.

5.4 Free Trials

We may offer free trials of Postmarks Premium. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

6. User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated means (bots, scripts) to access or manipulate the Service
• Impersonate any person or entity
• Share, sell, or transfer your account to another person
• Engage in any activity that artificially inflates step counts or progress
• Reverse engineer, decompile, or attempt to extract source code

7. Intellectual Property

All content in Postmarks, including stamps, route imagery, journal designs, logos, and software, is owned by Trip Wizard LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works based on our content without written permission.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that health data will be accurate or complete.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIP WIZARD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 if you have not made any payments.

11. Indemnification

You agree to indemnify and hold harmless Trip Wizard LLC and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or relating to your use of the Service, violation of these Terms, or violation of any rights of a third party.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Delaware.
